Property Listing Aggregation & Data Usage Policy

This Policy describes how sabahay.ph collects, displays, stores, and manages property listing information sourced from publicly accessible real estate websites, agency portals, developer pages, and other online platforms. This Policy applies to all real estate agencies, brokers, developers, property owners, and private users whose property listings appear on or are indexed by the Platform.

1. Purpose and Scope

This Policy describes how sabahay.ph (“we,” “our,” or the “Platform”) collects, displays, stores, and manages property listing information—including photographs, descriptions, pricing data, and contact details—sourced from publicly accessible real estate websites, agency portals, developer pages, and other online platforms (collectively, “Source Sites”). This Policy applies to all real estate agencies, brokers, developers, property owners, and private users (“Listing Owners”) whose property listings appear on or are indexed by the Platform.

2. Nature of the Service

The Platform operates as a property listing aggregator. We collect publicly available property listing data from Source Sites and republish it on the Platform free of charge. Our goal is to provide a centralized, searchable resource for property seekers in the Philippines. No fee is charged to Listing Owners for the inclusion or display of their listings.

3. Data We Collect and Display

For each aggregated listing, we may collect and display the following:

3.1 Property Photographs and Images

Property photographs and images as published on Source Sites.

3.2 Listing Descriptions and Specifications

Listing descriptions, floor plans, and specifications.

3.3 Pricing and Availability Information

Pricing and availability information.

3.4 Agency or Broker Information

Agency or broker name, logo, and publicly listed contact information (phone number, email, office address).

3.5 Geographic and Location Data

Geographic and location data associated with the property.

4. Legal Basis for Processing

We rely on the following legal and practical bases for aggregating and displaying listing data:

4.1 Legitimate Interest

We process publicly available listing data in pursuit of the legitimate interest of providing a comprehensive property search platform that benefits both property seekers and Listing Owners by increasing the visibility of their properties. We have conducted a balancing assessment and concluded that this interest is not overridden by the rights of Listing Owners, given that the data is already made public by or on behalf of the Listing Owner, and the Platform provides a free removal mechanism.

4.2 Public Availability

The listing data we aggregate has been made publicly accessible on the internet by or on behalf of the Listing Owner through Source Sites.

4.3 Attribution and Good Faith

We attribute all listing content to the original Source Site and/or Listing Owner and do not claim ownership of third-party content. Links or references to the original listing are provided where technically feasible.

5. Notification to Listing Owners

5.1 Notification Efforts

Upon adding a new listing to the Platform, we will make commercially reasonable efforts to notify the Listing Owner or their authorized representative. Notification may be sent via email, contact form submission, or other publicly available communication channels associated with the listing.

5.2 Notification Contents

The notification will include: (a) confirmation that the listing has been added to the Platform; (b) the URL where the listing can be viewed; (c) a summary of the data displayed; and (d) clear instructions on how to request modification or removal.

5.3 Rights Regardless of Notification

Failure to receive or acknowledge a notification does not constitute consent to the continued display of listing data. Listing Owners retain their rights under this Policy and applicable law regardless of whether notification was successfully delivered.

6. Right to Removal, Correction, and Deletion

Any Listing Owner—or authorized representative acting on their behalf—may, at any time and without charge, exercise the following rights:

6.1 Request Removal

Request that their listing (including all associated photographs and data) be removed from the Platform.

6.2 Request Correction

Request correction of any inaccurate, outdated, or misleading information displayed on the Platform.

6.3 Request Deletion

Request that all personal data and listing data associated with them be permanently deleted from our databases, caches, backups, and any derivative datasets, subject to our data retention obligations under applicable law.

6.4 Processing of Requests

Requests may be submitted via email to contact@sabahay.ph, through the “Request Removal” button on any listing page, or by written notice to our registered office address.

We will acknowledge receipt of any request within three (3) business days and will process valid requests within ten (10) business days from the date of acknowledgment.

Upon processing a removal or deletion request, we will:

  • Remove the listing and all associated images from public display
  • Purge the data from our primary databases
  • Remove the data from search engine caches under our control by requesting de-indexing
  • Delete the data from backup systems within thirty (30) calendar days

We will send confirmation to the requesting party once deletion has been completed.

7. Intellectual Property Acknowledgment

7.1 Copyright Protection

We acknowledge that photographs and original content included in property listings may be protected by copyright under the Intellectual Property Code of the Philippines (Republic Act No. 8293) and other applicable laws.

7.2 No Ownership Claim

We do not claim ownership of any third-party photographs, descriptions, or other content displayed on the Platform. All intellectual property rights remain with the original copyright holder.

7.3 Good Faith Display

Our display of listing content is made in good faith for informational purposes and to increase the visibility and reach of the Listing Owner's property. We attribute content to the original source wherever possible.

7.4 Copyright Infringement Claims

If a copyright holder believes their rights have been infringed, they may submit a takedown request following the process described in Section 6 or by sending a formal notice under Republic Act No. 10372 to contact@sabahay.ph.

8. Data Privacy Compliance

8.1 Data Privacy Act Compliance

To the extent that any aggregated data constitutes “personal information” or “sensitive personal information” as defined under the Data Privacy Act of 2012 (Republic Act No. 10173) and its Implementing Rules and Regulations, we commit to processing such data in compliance with the principles of transparency, legitimate purpose, and proportionality.

8.2 Data Subject Rights

Data subjects may exercise their rights under the Data Privacy Act, including the right to access, correct, and erase personal data, by contacting our Data Protection Officer at contact@sabahay.ph.

8.3 Security Measures

We maintain organizational, physical, and technical security measures to protect stored listing data against unauthorized access, alteration, disclosure, or destruction.

9. Data Retention

9.1 Active Listings

Active listings are retained for as long as they remain publicly available on the Source Site and are not subject to a removal request.

9.2 Inactive Listings

Listings that are no longer publicly available on the Source Site will be flagged as inactive and removed from public display within thirty (30) calendar days of detection.

9.3 Post-Removal Deletion

Following a valid removal or deletion request, data will be purged in accordance with the timelines set out in Section 6.6.

10. Limitation of Liability

The Platform displays listing data on an “as-is” basis. We do not guarantee the accuracy, completeness, or currency of any listing information. The Platform is not a party to any property transaction and does not provide real estate brokerage, advisory, or valuation services. Users should independently verify all listing information before making any decisions.
